Auction Terms and Conditions

These Auction Terms and Conditions govern participation in auctions conducted through MacDonald Gallery Auctions. By registering for an account, placing a bid, or participating in any auction on this website, you agree to these terms.

1. Auction Registration

All bidders must create an account and provide accurate contact information before placing bids.

MacDonald Gallery Auctions reserves the right to refuse, suspend, or remove bidding privileges at its discretion, including in cases of suspected fraud, misuse, non-payment, or abuse of the platform.

Bidders must be at least 18 years of age or otherwise legally permitted to enter binding purchase agreements in their jurisdiction.

2. Binding Bids

All bids placed through the auction platform constitute a binding agreement to purchase the artwork if the bidder is declared the winning bidder at the close of the auction.

Bids may not be withdrawn except in cases of clear technical error approved by MacDonald Gallery Auctions.

Placing false, fraudulent, or intentionally disruptive bids is prohibited.

3. Auction Closing and Winning Bids

Auctions close at the stated date and time shown on the auction listing page.

If automatic bid-extension functionality is enabled, bids placed shortly before closing may extend the auction end time to allow fair competitive bidding.

The highest accepted bid at the close of the auction will be deemed the winning bid, subject to payment verification and compliance with these Terms and Conditions.

In the event of a dispute, technical issue, suspected fraud, or system malfunction, MacDonald Gallery Auctions reserves the right to reopen, extend, cancel, or modify the auction at its discretion.

4. Payment

Winning bidders are responsible for completing payment within the timeframe specified after the auction closes.

Accepted payment methods may include credit card, bank transfer, approved invoicing arrangements, or other methods displayed during checkout or invoicing.

Failure to complete payment may result in:

cancellation of the sale,
suspension or termination of bidding privileges,
forfeiture of future bidding rights,
or the item being offered to another bidder.
5. Artwork Descriptions and Condition

5. Final Sale / No Refunds

All auction sales are final.

Because bids placed through the auction platform constitute binding purchase agreements, winning bidders are not entitled to refunds, returns, chargebacks, cancellations, or exchanges except where required by applicable law.

Failure to inspect descriptions, photographs, dimensions, shipping terms, or condition information before bidding does not constitute grounds for cancellation or refund.

If a winning bidder fails to complete payment, MacDonald Gallery Auctions reserves the right to:

  • cancel the transaction,
  • offer the artwork to another bidder,
  • suspend or terminate the bidder’s account,
  • pursue recovery of associated fees or damages where permitted by law,
  • and restrict future participation in auctions.

Any approved exceptions, if granted, shall be at the sole discretion of MacDonald Gallery Auctions.

Artwork descriptions, dimensions, materials, photographs, and condition details are provided in good faith.

Because original artwork is handmade, slight variations in color, texture, framing, or appearance may occur due to lighting, photography, monitor settings, and viewing conditions.

Bidders are encouraged to ask questions and request additional information before placing bids.

All artwork is sold as-is unless otherwise stated in the listing.

6. Pickup and Shipping

Winning bidders may arrange local pickup in Nashville, Tennessee, including pickup at Two Rivers Mansion when applicable and by appointment.

Shipping, delivery, insurance, handling, crating, or freight charges are not included in the winning bid amount unless explicitly stated in the auction listing.

The buyer is responsible for all shipping-related costs, taxes, customs fees, import duties, and destination charges.

Risk of loss transfers to the buyer upon pickup or transfer to the shipping carrier.

7. Charity and Benefit Auctions

Certain auctions may be conducted in support of charitable organizations, nonprofit entities, museums, historical properties, or fundraising initiatives.

Unless specifically stated otherwise, charitable contributions, deductions, or tax benefits are solely the responsibility of the bidder to verify with their tax advisor or applicable organization.

8. No Guarantee of Investment Value

Artwork purchases are made for personal enjoyment, collecting, or decorative purposes. No guarantee, representation, or warranty is made regarding future value, appreciation, investment return, or resale potential.

9. Limitation of Liability

MacDonald Gallery Auctions shall not be liable for:

technical interruptions,
internet failures,
bidding delays,
software malfunctions,
unauthorized account access,
shipping delays,
or indirect or consequential damages arising from participation in the auction.

Maximum liability shall not exceed the amount actually paid by the winning bidder for the specific artwork in dispute.

10. Right to Modify Auctions or Terms

MacDonald Gallery Auctions reserves the right to modify listings, correct errors, cancel auctions, update these Terms and Conditions, or revise platform policies at any time.

11. Governing Law

These Terms and Conditions shall be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

Any disputes arising from auction participation or artwork purchases shall be subject to the jurisdiction of the courts located in Tennessee.
