These Auction Terms and Conditions govern participation in auctions conducted through MacDonald Gallery Auctions. By registering for an account, placing a bid, or participating in any auction on this website, you agree to these terms.<\/p>\n
1. Auction Registration<\/p>\n
All bidders must create an account and provide accurate contact information before placing bids.<\/p>\n
MacDonald Gallery Auctions reserves the right to refuse, suspend, or remove bidding privileges at its discretion, including in cases of suspected fraud, misuse, non-payment, or abuse of the platform.<\/p>\n
Bidders must be at least 18 years of age or otherwise legally permitted to enter binding purchase agreements in their jurisdiction.<\/p>\n
2. Binding Bids<\/p>\n
All bids placed through the auction platform constitute a binding agreement to purchase the artwork if the bidder is declared the winning bidder at the close of the auction.<\/p>\n
Bids may not be withdrawn except in cases of clear technical error approved by MacDonald Gallery Auctions.<\/p>\n
Placing false, fraudulent, or intentionally disruptive bids is prohibited.<\/p>\n
3. Auction Closing and Winning Bids<\/p>\n
Auctions close at the stated date and time shown on the auction listing page.<\/p>\n
If automatic bid-extension functionality is enabled, bids placed shortly before closing may extend the auction end time to allow fair competitive bidding.<\/p>\n
The highest accepted bid at the close of the auction will be deemed the winning bid, subject to payment verification and compliance with these Terms and Conditions.<\/p>\n
In the event of a dispute, technical issue, suspected fraud, or system malfunction, MacDonald Gallery Auctions reserves the right to reopen, extend, cancel, or modify the auction at its discretion.<\/p>\n
4. Payment<\/p>\n
Winning bidders are responsible for completing payment within the timeframe specified after the auction closes.<\/p>\n
Accepted payment methods may include credit card, bank transfer, approved invoicing arrangements, or other methods displayed during checkout or invoicing.<\/p>\n
Failure to complete payment may result in:<\/p>\n
cancellation of the sale,
\nsuspension or termination of bidding privileges,
\nforfeiture of future bidding rights,
\nor the item being offered to another bidder.

5. Final Sale \/ No Refunds<\/p>\n
All auction sales are final.<\/p>\n
Because bids placed through the auction platform constitute binding purchase agreements, winning bidders are not entitled to refunds, returns, chargebacks, cancellations, or exchanges except where required by applicable law.<\/p>\n
Failure to inspect descriptions, photographs, dimensions, shipping terms, or condition information before bidding does not constitute grounds for cancellation or refund.<\/p>\n
If a winning bidder fails to complete payment, MacDonald Gallery Auctions reserves the right to:<\/p>\n
Any approved exceptions, if granted, shall be at the sole discretion of MacDonald Gallery Auctions.<\/p>\n
Artwork descriptions, dimensions, materials, photographs, and condition details are provided in good faith.<\/p>\n
Because original artwork is handmade, slight variations in color, texture, framing, or appearance may occur due to lighting, photography, monitor settings, and viewing conditions.<\/p>\n
Bidders are encouraged to ask questions and request additional information before placing bids.<\/p>\n
All artwork is sold as-is unless otherwise stated in the listing.<\/p>\n
6. Pickup and Shipping<\/p>\n
Winning bidders may arrange local pickup in Nashville, Tennessee, including pickup at Two Rivers Mansion when applicable and by appointment.<\/p>\n
Shipping, delivery, insurance, handling, crating, or freight charges are not included in the winning bid amount unless explicitly stated in the auction listing.<\/p>\n
The buyer is responsible for all shipping-related costs, taxes, customs fees, import duties, and destination charges.<\/p>\n
Risk of loss transfers to the buyer upon pickup or transfer to the shipping carrier.<\/p>\n
7. Charity and Benefit Auctions<\/p>\n
Certain auctions may be conducted in support of charitable organizations, nonprofit entities, museums, historical properties, or fundraising initiatives.<\/p>\n
Unless specifically stated otherwise, charitable contributions, deductions, or tax benefits are solely the responsibility of the bidder to verify with their tax advisor or applicable organization.<\/p>\n
8. No Guarantee of Investment Value<\/p>\n
Artwork purchases are made for personal enjoyment, collecting, or decorative purposes. No guarantee, representation, or warranty is made regarding future value, appreciation, investment return, or resale potential.<\/p>\n
9. Limitation of Liability<\/p>\n
MacDonald Gallery Auctions shall not be liable for:<\/p>\n
technical interruptions,
\ninternet failures,
\nbidding delays,
\nsoftware malfunctions,
\nunauthorized account access,
\nshipping delays,
\nor indirect or consequential damages arising from participation in the auction.<\/p>\n
Maximum liability shall not exceed the amount actually paid by the winning bidder for the specific artwork in dispute.<\/p>\n
10. Right to Modify Auctions or Terms<\/p>\n
MacDonald Gallery Auctions reserves the right to modify listings, correct errors, cancel auctions, update these Terms and Conditions, or revise platform policies at any time.<\/p>\n
11. Governing Law<\/p>\n
These Terms and Conditions shall be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.<\/p>\n
Any disputes arising from auction participation or artwork purchases shall be subject to the jurisdiction of the courts located in Tennessee.<\/p>\n
